The NSW Real Estate sector is regulated by the Office of Fair Trading who administer the Property Stock and Business Agents Act 2002 (PSBA) and other legislation. The legislation defines the roles, responsibilities and obligations of real estate agents, salespeople and property managers, and the educational requirements for each role.
The first step to becoming a real estate agent in NSW is to obtain your Certificate of Registration. With a Certificate of Registration you can work as a Real Estate Salesperson, or Property Manager for a licensed real estate agent in the residential or commercial sector. However, you cannot operate your own agency, nor may you employ other real estate agents, salespeople or property managers.
A licensed Real Estate Agent is able to operate a real estate agency and employ salespeople,property managers and other real estate agents to work in the agency in many different capacities. Separate Registration and Licence requirements apply to those wanting to work in Strata Management, Stock and Station, or Business Agency.
Each year all Certificate and Licence holders are required to complete a short Continuing Professional Development (CPD) Course and earn 12 CPD points in order to renew their registration or licence.
